Refund policy

At Vivid Gems Lab, we want every garment ordered through our website to arrive ready to become part of your wardrobe. We understand that clothing is personal: a shirt may fit differently than expected, a pair of pants may not have the preferred cut, or the color and appearance may not work as imagined on a particular screen.

This Return and Refund Policy establishes the conditions under which merchandise purchased through https://www.vividgemslab.beauty/ may be returned, exchanged, replaced, or refunded.

1. Eligibility for Returns

Unless a different term is expressly stated on the applicable product page or required by law, eligible merchandise may generally be returned within 30 calendar days after delivery.

For a standard return, the merchandise should:

  • Be unworn;
  • Be unwashed;
  • Be free from stains, makeup, perfume, deodorant marks, pet hair, smoke odor, or other contamination;
  • Remain in substantially original condition;
  • Retain original tags, labels, and accessories where reasonably available;
  • Not have been altered, tailored, repaired, or otherwise modified by the customer; and
  • Be accompanied by reasonable proof of purchase.

Customers are encouraged to inspect garments promptly after delivery and before removing tags or wearing the merchandise for an extended period.

2. Men's Short-Sleeve Shirts

Men's short-sleeve shirts should be carefully checked for:

  • Chest and shoulder measurements;
  • Sleeve length;
  • Overall garment length;
  • Collar configuration;
  • Fabric appearance;
  • Color;
  • Stitching;
  • Buttons or closures; and
  • Other visible characteristics.

A shirt may generally be tried on indoors for fit, provided it remains clean, unworn for ordinary use, and otherwise suitable for resale.

A shirt that has been washed, worn outdoors, stained, stretched, altered, or damaged after delivery may not qualify for a standard preference-based return.

3. Men's Pants

Customers should carefully review the listed waist, inseam, rise, leg shape, and other available measurements before purchasing pants.

Pants may generally be inspected and tried on in a clean indoor environment.

A pair of pants may become ineligible for an ordinary return if it has been:

  • Washed;
  • Worn for regular activities;
  • Tailored;
  • Hemmed;
  • Stained;
  • Damaged;
  • Exposed to strong odors; or
  • Otherwise altered after delivery.

4. Incorrect, Defective, or Damaged Merchandise

If merchandise arrives defective, damaged, or materially different from the product ordered, please contact us promptly.

Examples include:

  • Receiving the wrong garment;
  • Receiving the wrong size when the wrong size was shipped by us;
  • Significant manufacturing defects;
  • Major tears or holes present upon arrival;
  • Broken closures;
  • Severe stitching failures;
  • Material damage occurring before delivery; or
  • A material discrepancy between the ordered and delivered product.

Please provide your order information and, where appropriate, clear photographs of the product, tags, packaging, and defect.

Depending on the circumstances, we may provide a replacement, replacement item, refund, partial refund, or another reasonable remedy.

5. Wrong Size Selected by Customer

Customers are responsible for selecting the appropriate size based on the measurements and information supplied with the product listing.

If the customer selected the wrong size, an ordinary return may still be possible if the merchandise meets the standard return conditions.

The customer may be responsible for applicable return shipping costs for a preference-based size return unless we expressly agree otherwise.

6. Color and Appearance

We make reasonable efforts to display colors accurately. However, colors may appear somewhat different because of:

  • Monitor settings;
  • Mobile-device displays;
  • Screen brightness;
  • Lighting conditions;
  • Photography conditions; and
  • Individual visual settings.

Minor visual differences that do not constitute a material product discrepancy may not independently establish a defect.

7. Refunds

After an authorized return is received, we may inspect the merchandise to determine whether it satisfies this Policy.

Approved refunds will generally be issued to the original payment method.

The time required for a refund to appear in a customer's account may vary depending on the payment processor, card issuer, financial institution, or other payment provider.

Where legally permissible, an ordinary customer-preference return may be subject to applicable return-shipping costs or other disclosed charges.

8. Exchanges

When inventory permits, we may offer exchanges for eligible merchandise.

An exchange may be requested for a different:

  • Size;
  • Color;
  • Style; or
  • Comparable item.

An exchange is subject to inventory availability.

If the replacement merchandise has a higher or lower price, the applicable price difference may need to be collected or refunded.

Once an order has entered fulfillment or been handed to a carrier, cancellation may no longer be possible. In that situation, the customer may need to use the standard return procedure after delivery.

10. Return Shipping

For a return caused by a customer's preference, such as choosing the wrong size, changing their mind, or no longer wanting the merchandise, the customer may be responsible for return shipping.

When the return results from our error, such as an incorrect item or a qualifying defective product, we will review the circumstances and determine an appropriate shipping solution.

Customers should not send merchandise to the return address without first contacting customer service when return instructions are required.

11. Items That May Be Refused

A return may be refused when merchandise:

  • Has been worn beyond reasonable fitting;
  • Has been washed;
  • Has been altered or tailored;
  • Is heavily stained;
  • Has strong smoke, perfume, chemical, or other persistent odors;
  • Is materially damaged after delivery;
  • Is missing essential components or labels where those are necessary to establish resale condition;
  • Is returned outside the applicable return period; or
  • Cannot reasonably be resold because of customer-caused condition changes.

This does not limit any rights that applicable law requires us to honor.

12. Florida Refund Requirements

Florida Statutes §501.142 addresses refund-policy disclosure for retail establishments. Among other provisions, it requires a retail establishment that offers no cash refund, credit refund, or merchandise exchange to post an appropriate notice and provides statutory consequences when the required notice is not given. The statute also expressly permits a retailer to adopt a refund period exceeding the statutory period.

This Policy is intended to provide customers with clear advance information concerning our return practices.

Nothing in this Policy is intended to waive or restrict a consumer protection, warranty, remedy, or other right that cannot legally be waived.
